Terms of Service

1. Acceptance

By accessing or using Signalant ("the Service") at signalant.io, you agree to these Terms of Service. The Service is operated by Juming Delmas Studios ("JDS"), 914 Railroad Ave, Tallahassee, FL 32310.

2. Description of service

Signalant is a SaaS platform for podcast producers and hosts. It provides tools for guest research, outreach automation, production tracking, and AI-assisted content generation. JDS is the sole operator of Signalant and the only party collecting subscription payments.

3. Subscription and billing

Paid plans are billed monthly through Stripe. By subscribing, you authorize JDS to charge your payment method on a recurring basis. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period. No refunds are issued for partial months.

4. Acceptable use

You agree not to use Signalant to:

• Send unsolicited commercial email in violation of CAN-SPAM, GDPR, or CASL
• Harvest contact data for purposes unrelated to podcast guest outreach
• Attempt to reverse-engineer, scrape, or exploit the platform
• Upload content that is illegal, defamatory, or infringes third-party rights

You are solely responsible for the content of any outreach messages sent through the platform. Signalant's compliance gates assist with regulatory adherence but do not guarantee legal compliance.

5. Intellectual property

You retain ownership of your show data, guest lists, and content you input. JDS retains ownership of the Signalant platform, software, and brand. You grant JDS a limited license to process your data to provide the Service.

6. Limitation of liability

To the maximum extent permitted by law, JDS shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid JDS in the 3 months preceding the claim.

7. Termination

JDS may suspend or terminate accounts that violate these Terms. You may terminate your account at any time by contacting hello@jdelmasstudios.com.

8. Governing law

These Terms are governed by the laws of the State of Florida, USA. Disputes shall be resolved in courts located in Leon County, Florida.

9. Changes to these terms

We may update these Terms periodically. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. Material changes will be notified by email at least 14 days in advance.
